Maillard Abogados Laborales and/or Maillard Canudas Argumedo Palma y Asociados (hereinafter, jointly or individually, “Maillard”) is committed to complying with the legal framework applicable to the protection of personal data, particularly the Mexican Federal Law on the Protection of Personal Data Held by Private Parties, its Regulations, and the guidelines issued by the competent authority.

This Privacy Notice is intended to inform you (the “Data Subject”) about the processing that Maillard carries out with respect to the personal data it collects when you are or have been a client, collaborator, service provider, job applicant, website visitor, or maintain any other relationship with Maillard.

Maillard, with address at Río Po No. 39, Col. Cuauhtémoc, C.P. 06500, Mexico City, is responsible for the processing of your personal data.

In addition, Maillard has an office at Calle Aldous Huxley 5055, Interior 2, Col. Jardines Universidad, C.P. 45110, Zapopan, Jalisco, Mexico.

  • Tax ID (RFC)
  • Unique Population Registry Code (CURP)

  • LinkedIn profile or other professional networks
  • Documents proving residency (in the case of foreign nationals)

Maillard may also collect sensitive personal data, including:

  • Ethnic or racial origin

  • Religious, philosophical, or moral beliefs
  • Political opinions
  • Sexual preference
  • Trade union membership
  • Photograph and personal video
  • Gender, age, and nationality
  • Health status, medical examinations, weight, height, illnesses, treatments, immunization records, injuries or accidents, and involvement in alimony proceedings
  • Results of socioeconomic studies
  • Results of medical and toxicological studies, including drug testing and blood alcohol concentration

For collection, payment, reimbursement, or tax deduction purposes, Maillard may collect financial or asset data. In such cases, express consent will be obtained in accordance with applicable law.

III. Purposes of Processing

Primary purposes (necessary for the legal relationship or the provision of services):

  • Responding to, managing, and following up on information requests, comments, inquiries, or contact, as well as administering the provision of professional services.
  • Recruitment and selection of personnel.
  • Integration into Maillard’s career center.
  • Integration into the provider registry.
  • Integration and management of the client portfolio and professional relationship.
  • Handling of requests received through the website.
  • Compliance with obligations arising from commercial or civil transactions.
  • Management of financial operations, payments, and administrative and accounting duties.
  • Handling of complaints, clarifications, and requests.
  • Internal management resulting from an employment relationship, where applicable.
  • Compliance with tax, labor, social security, and immigration obligations, as well as responding to requests from competent authorities.
  • Identification and verification of the personal data provided.
    Secondary purposes (not necessary for the main relationship):
  • Statistical purposes to evaluate the quality of services provided.
  • Sending information about products, services, promotions, surveys, or notices of interest.
  • Advertising and commercial prospecting.
  • General analysis of website navigation and use.
    If you do not wish your personal data to be used for secondary purposes, you may object through the mechanisms indicated in this Notice.

IV. Options to Limit Use or Disclosure

You may limit the use or disclosure of your personal data, as well as request the cancellation of notifications or promotions, by sending an email to soporte@maillard.com.mx or calling +52 (55) 5662 9882.

V. ARCO Rights

You have the right to Access, Rectify, Cancel, or Object to the processing of your personal data (ARCO rights). To exercise these rights, submit a request to soporte@maillard.com.mx, accompanied by proof of identity and a clear description of the data concerned.

Maillard will respond within a maximum of 20 business days. If the request is granted, it will be implemented within the following 15 business days.

VI. Revocation of Consent

You may revoke at any time the consent granted for the processing of your personal data by following the same procedure described for the exercise of ARCO rights.

VII. Data Transfers

Maillard may share personal data with its affiliates, service providers, and, when necessary, with third parties for the performance of activities related to the relationship with Maillard, within or outside Mexico. Such third parties will be required to maintain the same level of confidentiality. Maillard will not transfer personal data to third parties without your consent, except in the cases of exception provided for in Article 37 of the Law.

VIII. Changes to this Privacy Notice

Maillard reserves the right to modify or update this Privacy Notice at any time. Modifications will be brought to the attention of the Data Subject through the contact means provided or by publication on the website.

IX. Security Measures

Maillard implements administrative, physical, and technological security measures to protect personal data against loss, misuse, or alteration.

X. Consent

It will be understood that the Data Subject grants tacit consent when this Privacy Notice is made available and no objection is expressed. In the case of sensitive data, express written consent will be required; in the case of financial or asset data, express consent will be required in accordance with applicable law.

XII. Competent Authority

If you believe that your rights have been violated, you may file a complaint with the competent personal data protection authority.
